The form treats the two kinds of agent differently. A commercial agent has paid the $1,000 listing fee and is already on file. Name one and your filing skips it. Name a noncommercial agent and you must supply a full North Dakota street address. Anyone searching the business database can read it.
There is a trapdoor under casual appointments. The state says you must get the agent's approval before naming them. Failing to do so may lead to involuntary dissolution. Proof of approval is never filed. So the whole risk sits with the founder who assumed a relative would not mind.
The report deadline is a fixed date, not your anniversary. Two dates, not one. An ordinary North Dakota LLC files by November 15. A farming or ranching LLC files by April 15, and so does an authorized livestock farm LLC. The Secretary of State publishes both dates on the same page, and the one that applies to you is set by the LLC type you registered as, not by when you formed. A founder who misses it has no private due date to lean on. An agent that sends reminders is selling the one thing the deadline lacks.
